Court Rules in Favor of Seyfarth Shaw IP Team in Patent Infringement Suit

CHICAGO (September 12, 2011) — Lawyers in Seyfarth Shaw LLP’s Intellectual Property practice, Alan Unikel, Dan Schwartz and Matt Werber, successfully obtained a summary judgment of non-infringement on behalf of the firm’s client, Westex, Inc., a global leader in the manufacturing of flame-resistant fabrics.

In July 2011, the U.S. District Court for the Northern District of Illinois ruled in favor of Westex in claim construction proceedings involving a patent related to flame-resistant cotton-blend fabrics. Based on the ruling, the plaintiff conceded that none of Westex's flame-resistant fabrics would infringe the patent. The case settled shortly thereafter on very favorable terms for Westex. The resolution of this lawsuit concludes more than five years of litigation, which eventually came to include numerous manufacturers and sellers of flame-resistant fabrics and garments, and which also included two separate re-examination proceedings before the U.S. Patent & Trademark Office.
