“Temporary Complication in Coverage of Young Adults Poses Administrative Challenges” and “Payment of Coverage for Eligible Adult Child Permitted on Pretax Basis”

David Weiner was quoted on May 19, 2010 in two SHRM Online articles, “Temporary Complication in Coverage of Young Adults Poses Administrative Challenges” and “Payment of Coverage for Eligible Adult Child Permitted on Pretax Basis.” Both articles discussed the Patient Protection and Affordable Care Act (PPACA), which requires employers to provide health insurance to adult children until the age of 26.

According to the "Temporary Complication" article, for grandfathered group health plans, there is a “temporary complication” in providing coverage to adult children until age 26. Under the PPACA, a grandfathered plan would not have to offer coverage to an adult child until 2014 if the child is eligible for other employer-sponsored coverage. The “temporary complication” is that the employee-parent consequently would have to prove a negative, namely that the child is not eligible for other coverage. The law is no longer based on the child’s student status but related to his employment status and if the child is eligible to receive his own health insurance. David noted that “the whole adult kid question got a little easier. We don’t have to track education nor financial independence, just parentage and age.”

David also noted in the "Payment of Coverage" article that the premiums for eligible adult children’s coverage is permitted to be paid on a pretax basis.
