“The Rise of Hospital Outpatient Departments in the Era of Decreased Provider Reimbursement”

Seyfarth Shaw attorneys Deborah Gordon and Jonathan Ishee authored an article published in the April 2013 issue of Business Law & Governance discussing the legal issues resulting from physicians and hospitals taking advantage of hospital-based reimbursement rates in lieu of declining reimbursement for provider-based ancillary services. According to Deb and Jonathan, this has led to an increase in the number of hospital outpatient departments and in the rate in which they provide certain services once only delivered in freestanding facilities and doctors’ offices, and the article addresses the legal issues physicians and hospitals should keep in mind if they wish to capitalize on the hospital-based reimbursement rates.
