Dennis Greenstein Quoted in the The New York Times
"Condo Space as a Workplace"

Seyfarth Shaw New York Real Estate partner Dennis Greenstein was recently quoted in a New York Times Q&A on October 27. The question posed was from a therapist who wanted to purchase a condo in New York in which he could also see patients in his practice. He asked if there was a need for it to be "explicitly allowed" by the condo board or in an offering plan.

Dennis replied regarding a condo's bylaws, "Many state that a residential unit may be used not only as a residence, but, subject to compliance with the bylaws, for a lawful home-occupation use." According to New York's zoning laws, "home occupation" is secondary to "residential use," and condo owners may only use no more than 25 percent of the floor area, and that 25 percent can be no more than 500 square feet.
