Environmental and Employment Attorneys Form Swine Flu Task Force
Environmental attorneys and Employment attorneys have formed a task force to assist in responding to questions regarding the H1 N1 influenza virus commonly known as Swine Flu. OSHA has jurisdiction over workplace safety issues and even though there is no specific OSHA regulation governing influenza, OSHA, the Centers for Disease Control ("CDC") and the Department of Homeland Security have published guidance for employers. OSHA is also using its inspection and enforcement authority to investigate allegations of alleged workplace hazards related to this influenza. In addition, there are numerous other employment issues that may arise. These include employee privacy, relaxing attendance policies, the application of benefits policies as well as potential Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), and Health Insurance Profitability and Accountability Act (HIPPA) issues. Further, multinational employers may have unique issues related to travel and cross boarder issues that include pandemic planning etc.
