James Sullivan Discusses the Impact of Bankruptcy on Employees in The National Law Review

The National Law Review quoted James Sullivan in its article, “Understanding Employee Considerations Under Bankruptcy,” on April 23. Sullivan discussed the importance of building consensus early in a bankruptcy case, particularly when introducing compensation structures or modifying employment contracts.

“Even if a proposed bonus plan has support from lenders and insiders, the US Trustee or the unsecured creditors’ committee might push back. In most cases, these objections lead to negotiation rather than full-blown litigation.”
