Real Estate partner Jay Gitles' article, "Landlord’s Waiver or Subordination to Tenant’s Lender’s Security Interest," was published in the March 2011 issue of Commercial Leasing Law & Strategy. Jay's article discusses commercial real estate lease forms (and most states' laws) that grant the landlord a lien on the tenant's personal property located at the leased premises in the event of an uncured default by the tenant under the lease. In his article, Jay points out issues that lenders should consider as they review, evaluate and negotiate the Waiver (or Subordnation) and Consent Agreement.
