The Winter 2007 issue of Commercial Insight, a newsletter published by the National Commercial Services Division of First American Title Insurance Company, includes Jeff's article, "Legal Issues When Acquiring a Net Lease Property," which explains that that "Often, investors who acquire net lease properties believe that passive ownership of real property means passive acquisition of real property. Nothing can be further from the truth. . . . With an investment in which so much of the value is tied to the lease and the tenant's obligations under the lease, extra vigilance during the acquisition process is an imperative." Jeff notes issues that need to be thoroughly reviewed include: gaps in the tenant's obligations; end of term issues; alterations to the property and options on the property including extension or renewal options, purchase options, rights of first refusal to purchase and expansion options.
