"Diebold Wins Fight Over Treasury Security Contest"
Seyfarth Shaw partner Joseph Dyer was quoted in Law360 on June 9 in an article regarding a decision by the U.S. Government Accountability Office (GAO) siding with firm client, Diebold, Inc., a global provider of integrated self-service security systems and services.
Diebold claimed the U.S. Department of the Treasury "improperly modified" a security services contract the company had with ADT, and it argued that the Treasury Department was required to amend the request for proposals in order to allow Diebold to respond to the modifications.
GAO agreed that Diebold was treated unfairly and was "prejudiced by the agency's actions."
Joseph commented, "GAO sustained the protest, finding that the Office of Comptroller of the Currency allowed ADT to revise the terms in various respects, an opportunity that was not allowed to Diebold. The decision underscores GAO's commitment to equal treatment among offerors."
