This session will cover various conditions that a landlord must meet in order to achieve “delivery of possession.” Topics will include a fact pattern that addresses what it means to deliver possession and what happens when the parties cannot agree whether “possession” has, in fact, been delivered. These issues will be reviewed from both a transactional and litigation lenses.
