Privacy Daily quoted Kathleen McConnell and Vincent Smolczynski in its article, “Amending CIPA May Limit Litigation, Though Workarounds Possible,” on May 30. The Seyfarth attorneys discussed how a bill to amend the California Invasion of Privacy Act (CIPA) could reduce the number of lawsuits if passed, though plaintiffs’ attorneys may still find alternative ways to bring claims.

McConnell said:

“The wake of lawsuits and demand letters is really impacting the way that businesses are operating, influencing choices about how they're going to handle disclosures around the operation of cookies, pixels and related technologies on their websites.”

Smolczynski continued:

“It potentially could have a litigation-lessening effect, but it could also, in some instances, invite additional interpretation or challenges on that front as well.”
