Kurt Kappes was quoted in the August 29, 2008 issue of the Sacramento Business Journal in the article, "Lawyers Discover New Challenges with E-data." The article discussed the staggering amount of electronic data that may be involved in a legal proceeding, such as during the Enron case when seven terabytes of information (equal to a stack of documents 50 miles high) was investigated. In addition to questions of logistics and size, the article noted that there are issues surrounding confidentiality, record-keeping and 'metadata,' the electronic footprints that track electronically stored information.

The privacy protection of electronic data can vary, but if the data is stolen, it's much harder to protect. Kurt advises clients that "it's much better to audit your computers and systems before (theft) happens because of the inherent uncertainties in litigation." Kurt also explained that it is essential for clients to "review their agreements with employees to make sure they're signed since sometimes the agreements are misplaced when an employees leaves or the provisions of the agreements do not comply with the law."
