Law360 quoted Ben Conley, partner in Seyfarth’s Employee Benefits department, in its article, “3 Takeaways From EBSA’s New Health Parity Guidance Docs.” The piece, published September 11, 2026, examines recently issued Department of Labor guidance addressing mental health parity compliance, enforcement priorities and health plan oversight of service providers.

Conley noted that the guidance gives employers more detailed examples of provisions that may raise compliance concerns:

“Red flags are helpful because that's one of the things employers always want, is examples of problematic provisions. You always, historically, had some modicum of this in the congressional report, but those were few and far between, and not that detailed.”

He further highlighted the practical value of the Department’s suggested questions for third-party administrators:

“I think it's helpful for the employer community to uniformly be able to go to service providers and say, 'Look, we are regulated by the Department of Labor. We have fiduciary obligations under ERISA. Here is what the DOL is telling us we should ask you. How are you responding to this?'”
