Lexology quoted Seyfarth partner Matthew Banham in its January 20 article, “Why pharma counsel can't rely on standard fraud defences anymore,” on how the UK’s new failure to prevent fraud (FTPF) offence reshapes fraud risk for pharmaceutical companies, particularly around third-party relationships and the need for more robust, sector-specific controls.

Banham emphasized: “fraud risk is often treated as a one-off exercise, with limited monitoring, fragmented ownership across business units, and poor documentation. These gaps create silos and weaken a company’s ability to demonstrate a robust defence under ECCTA.”
