Marc Gurell was quoted in an April 21 story from Law360, “How Courts May Handle Real Estate Force Majeure Suits.” Gurell said New York courts have historically interpreted force majeure clauses narrowly and have consistently held that a party will only be excused from performance if the event in question was specifically addressed within the contract and the event actually prevents the party’s performance.
