Mark Lies was quoted in the April 29, 2009 Employment Law360 article, “Employers Should Act Now To Avoid Swine Flu Liability.” The article discussed how employers should take steps to avoid liability issues arising from the possible swine flu pandemic. Mark noted, “Under the Occupational Safety and Health Act (OSHA), an employer has an obligation to maintain a safe and healthful workplace, and the employer is required to safeguard its workers from recognized hazards to safety or health that may cause injury or death.” Mark commented that OSHA may require employers in higher risk industries, such as transportation or health care, to develop a plan with procedures to protect employees that may have greater exposure to swine influenza. According to the article, employees should practice good hygiene and stay home if they are sick even though the seasonal flu is not covered by the Family Medical Leave Act. Mark noted, “If swine flu is considered a serious health condition, it may warrant the employer giving the employee unpaid leave.”
