Massachusetts SJC Holds That Specific Performance and Liquidated Damages are Alternative Remedies

The Supreme Judicial Court of Massachusetts has ruled that a seller of real property is not entitled to liquidated damages for a buyer’s breach of a contract for the sale of real property where, subsequent to the breach, the seller obtained court-ordered specific performance from the buyer to purchase the property.
