Seyfarth Shaw Labor & Employment partner Michael Wexler was quoted in Crain's Chicago Business's May 22 edition regarding a cardiologist's dispute over a contract.

The president of the Chicago Cardiology Institute filed suit against a cardiologist who was a former employee and left the practice earlier this year. According to Crain's, the former cardiologist is violating his contract by competing against the four-doctor group, which has key relationships with Arlington Heights-based Alexian Brothers Health System and Sherman Hospital. The article goes on to reveal that non-compete clauses in employment contracts sometimes make it difficult for physicians to treat their former patients once they set up their own practices, and the cardiologist in this instance posits that it's "all about the big buck" and not the patient care.

The article points out that non-compete clauses in employment contracts can be difficult for doctors who start their own practices to treat former patients, since these clauses are meant to protect the practice, and not necessarily the patients.

Michael states in the article, “Covenants are difficult to enforce because they're not favored.”
