"Employers Prepare for FTC Identity Theft Rules"
Pamela Devata’s article, "Employers Prepare for FTC Identity Theft Rules," was published in the August 2008 issue of the Society for Human Resource Management newsletter. In her article, Pam writes about regulations issued by the Federal Trade Commission (FTC) and mandated by The Fair and Accurate Credit Transaction Act of 2003 (FACTA) that will go into effect this Fall. According to Pam, "the regulations require the creation of a number of policies and procedures for specified entities. As of November 1, 2008, all users of consumer reports must adhere to regulations regarding address discrepancies whenever they obtain consumer reports from nationwide CRAs, such as Experian, Equifax and TransUnion, but not other consumer reporting agencies."
Pam provides details on the new regulations and explains the practical implications for employers. She recommends that "employers and other entities covered by the regulations should consult with an experienced labor and employment attorney before implementing any sort of identity theft prevention program."
