“FTC Pounds Infomercial Co. Over Weight Loss Claims”

Peter Brooks was quoted in the article “FTC Pounds Infomercial Co. Over Weight Loss Claims,” published in the October 11, 2007 issue of Product Liability Law 360 . The article explains that  “the Federal Trade Commission filed a lawsuit on October 4 targeting makers of an infomercial for allegedly deceiving consumers by promoting a weight loss book that claims to be ‘easy’ but relies on severe dieting restrictions and daily injections of a drug that has not been approved for weight loss by the Food and Drug Administration.

Peter, notes that “he was astounded that the FTC filed the lawsuit.” He points out, “well-established case law and FTC precedent have decreed that speech which accurately represents what is in a book for advertising is protected by the first amendment.” Peter notes, “I think some of this is personal, if you will, I don’t think the suit would have been filed if someone other than Kevin Trudeau of Direct Marketing was producing the same commercial.”
