Robert Milligan Quoted in The National Law Journal "California High Court Kicks Moribund Noncompete Clauses Closer to the Grave"
Robert Milligan was quoted in the August 11, 2008 issue of The National Law Journal in the article “California High Court Kicks Moribund Noncompete Clauses Closer to the Grave.” The article reported on the recent California high court decision, Edwards v. Arthur Andersen LLP, which found that "employers may not restrain departing workers by imposing terms that forbid that employee working with his old clients after joining a rival employer." The article also noted that "... California now has the most restrictive controls on employer use of noncompete clauses in contracts of any state." However, in its decision, the court seemingly held open the possibility of an exception when it comes to the protection of trade secrets.
Robert remarked on the practical implications for employers by explaining that they “will want to make sure that they have not asked their employees to sign non-competition agreements or non-solicit of customers agreements that can be construed as non-competition agreements."
