“The Implied Warranty of Habitability in Residential Developments”
The April 2007 issue of Real Estate Finance includes an article by Roger Price. Roger explains in his piece, “The Implied Warranty of Habitability in Residential Developments,” that judicial precedent in many states hold that “consumer protection warranties are implied into contracts for the sale of dwellings…. Among these implied warranties is one for ‘habitability.’” Because the nature and extent of such warranties varies widely from one state to the next, Roger says that “builder/vendors in each state must understand the scope of the warranties implied in their state.” Moreover, the legal landscape concerning the implied warranty of habitability shifts and develops on a case-by-case basis, which underscores the importance of builder/vendors to be “acutely aware of the ever changing legal landscape.”
