A chapter titled “Discoverability,” co-authored by Scott A. Carlson, co-chair of the firm’s eDiscovery group, and Jason Priebe, Senior Counsel, was published in the IICLE 2012 E-Discovery Handbook. In this chapter, Scott and Jason cover the discoverability of electronically stored information (ESI) in Illinois and sources of potentially relevant ESI.

The modern litigant must carefully consider what information is necessary to his or her case. Requesting or sending extremely broad discovery requests to opposing counsel only increases time, cost, and energy needed by both parties. Researching the format, medium, physical location, transitory characteristics, amount and quality of the information available and potentially relevant to the facts at issue all combine to form the concept known as “discoverability.”
