It is not widely recognized how important Directors and Officers Insurance is to the functioning of corporations and the capital markets, and as a result, the economy of the United States. Many of the most able and experienced directors and officers would not serve in their present capacities were it not for adequate amounts of D&O coverage being available to cover litigation costs and liability related to their work in their current capacities. Financing from our capital markets would not be viable in many instances without the availability of D&O coverage for many types of participants. Also important to the functioning of the economy is that the price of D&O insurance not become prohibitive. One of the most significant costs for insurers affecting pricing is the cost of litigation in the form of legal fees, settlements, and judgments.

This panel will feature Kevin LaCroix and Priya Huskins, two of the country’s leading and best known commentators on D&O insurance, Jarrod Schlesinger of Chubb, a leading voice on the critical need for reform of the securities laws and the state of health of the D&O industry, Giovanna Ferrari a rising star in securities litigation and, as moderator, a nationally known litigator in the world of securities litigation and corporate governance, Greg Markel.

During this webinar, our panelists will discuss:

  • Trends in securities class actions, merger litigation, claims against technology companies, and derivative actions.
  • Developments in the law which have affected and will affect the number of filings and their cost.
  • The role of the pandemic on the amount and type of litigation experienced.
  • Important new types of claims relating to diversity, ESG, Cybersecurity, and similar topics.
  • D&O pricing, costs, and market volatility.
  • The need for reform of the securities class action law.
