Seong Kim Discusses SCOTUS Hearing Pension Plan Case Next Term in SHRM
SHRM quoted Seong Kim in its article, “Supreme Court to Hear Multiemployer Pension Plan Case Next Term,” on August 21. Kim explained what multiemployer pension plans are, and noted that an upcoming US Supreme Court case—M & K Employee Solutions LLC v. Trustees of the IAM National Pension Fund—will address how these plans calculate withdrawal liability for employers exiting the plans.
“Contributing employers to a multiemployer plan are usually part of the same industry. Multiemployer plans are more prevalent in traditionally unionized industries where it is common for employees to move between employers — for example, construction, manufacturing, mining, entertainment, grocery, hotel and service, maritime, trucking, etc.”
