Seyfarth Adds Public Pension Lawyer Javier Plasencia in Sacramento
SACRAMENTO (February 4, 2016) - Seyfarth Shaw LLP announced today the arrival of counsel F. Javier Plasencia to the firm’s Real Estate Pension Fund, Institutional Investor & Private Equity practice in Sacramento. Plasencia joins the firm from the California Public Employees' Retirement System (CalPERS) where he worked for more than 25 years. For the past 15 years, Plasencia served as primary in-house senior counsel to CalPERS’ Real Assets portfolio, where he advised on and managed all legal aspects, including commingled funds and direct investment acquisitions and dispositions, separate accounts, emerging managers, and development of Real Assets investment policies and procedures.
Plasencia worked extensively with Real Assets staff, legal staff and outside counsel on the implementation of CalPERS’ alignment of interest model for its Separate Account investment program. He addressed issues pertaining to indemnification, fiduciary duties, governance issues, fair market values, dispute resolutions, compensation/incentive fees, CalPERS' tax-exempt status, responsible contracting, placement agents, insurance claims and litigation, appraisals, conflicts, and FOIA. Plasencia reviewed and advised on real estate RFPs and investment service contracts, including valuations, insurance brokers, and board consultants. He also worked extensively on real estate matters and compliance with the California Public Employees’ Retirement Law, the California Public Contract Code, and applicable federal laws. Prior to being fully assigned to the Real Estate Unit, Plasencia represented CalPERS on benefit related issues, such as member classification and final compensation issues.
In joining Seyfarth’s Real Estate Pension Fund, Institutional Investor & Private Equity practice, Plasencia will be a valuable addition to the team in providing innovative investment counseling to some of the largest public and private pension funds, insurance companies, private investment companies, REITs, and private equity firms. In addition to representing real estate focused private equity firms in their joint ventures, acquisitions and dispositions of income-producing and development properties, the team also regularly represents institutional investors in organizing and planning co-investments, joint ventures, and private and public REITs.
Plasencia received a J.D. from the University of San Francisco School of Law and is a member of the National Association of Public Pension Attorneys (NAPPA). He speaks and writes fluently in Spanish.
