WASHINGTON, D.C. (May 23, 2011) — Seyfarth Shaw LLP’s nationally recognized Construction practice and Washington, D.C. partner and LEED® Accredited Professional David Blake are pleased to announce the completion of two addenda that will be of use to owners, developers, design professionals and contractors who wish to address issues involved in construction projects seeking LEED certification, the recognized building standard for measuring building sustainability.
Seyfarth’s new Green Building Addendum for Design Contracts and updated Green Building Addendum for Construction Contracts can be attached to and used with nearly any design or construction contract, providing comprehensive and integrated solutions and allowing for customization based on the project and the risk profile of the parties involved.
The addenda include definitions for green building issues, the type and level of LEED certification being sought for the project, the parties’ responsibilities for the LEED registration and certification process, the prerequisites and credits for the project and the parties’ responsibilities concerning them, the submittal process for green building components, the correlation between LEED certification and substantial completion, final completion and final payment, design changes that affect prerequisites and credits, scheduling issues concerning green components and processes, allowances for green components, numerous option remedies if LEED certification is not achieved or specific credits are not satisfied.
