Arren Goldman, partner in Seyfarth's Real Estate department and co-lead of the firm's Distressed Situations team, will serve as a panelist during the session, "Working With the Lender: Workouts, Modifications and Refinancing in a Tight Credit Market." At this session, panelists will discuss how lenders are approaching distressed borrowers in today’s market; proactive methods for borrowers to approach lenders when facing maturity or covenant issues; the most common workout structures being used today (e.g., A/B notes, rate resets, maturity extensions); refinancing options available for borrowers facing a capital shortfall; how borrowers are using rescue capital, preferred equity, and mezzanine to bridge the gap; the legal, financial, and operational tools available for restructuring; and successful workouts and the biggest mistakes to learn from recent refinancing examples.
James Sowka, partner in Seyfarth's Corporate department and co-lead of the firm's Distressed Situations team, will serve as a panelist during the session, "Servicers, special assets, special situations and strategic workouts: Extension, enforcement, or exit?" At this session, panelists will discuss the evolving role of special servicers and special assets in a non-CMBS-heavy cycle; how non-bank lenders are approaching workouts vs. enforcement; what the most common workout structures being used are; how servicers are handling valuation uncertainty in today’s market; whether they are relying on appraisals, broker opinions, or market bids to guide decisions; mediation strategies between borrowers and servicers; and legal, operational, and capital market implications.
