Stanley Jutkowitz, senior counsel in Seyfarth's Corporate department and leader of the firm's Cannabis Law practice, will be serving as a panelist for "Cannabis Legislative History and Current Trends" at the ABA Real Estate, Condemnation and Trust Litigation Committee’s Cannabis Law Regional Conference in Chicago, IL on September 12, 2022.

Marijuana and hemp are technically the same plant, and since the 1930s (and currently codified in the Controlled Substances Act ("CSA")), federal law has declared the use, sale, or distribution of marijuana to be illegal. Until the Agriculture Improvement Act of 2018 removed hemp from the CSA, hemp was also illegal. Panelists will discuss the main distinctions between marijuana and hemp and why they are treated differently. They will also explore the concerns of the FDA and its involvement with regulation and development and discuss the law in Illinois and state licensing in general.
