Webinar Recording: A Hot Mess of ICE-Cold I-9 Compliance Concerns

As businesses reopen their worksites, and craft hybrid and remote-working arrangements for their employees, in-house counsel and HR leaders continue to seek clarity on Form I-9 compliance issues.   

Business leaders, advocacy groups, and bar and HR associations alike have been urging the federal government to clarify for employers the increasingly challenging compliance dilemmas that arise in an array of “return to work,” in-person  I-9 scenarios. The problem is particularly acute for employers with high-volume hiring needs.  This dialogue with federal immigration agencies has focused on several points:

  • The government’s continuously evolving (some would say, confusing) I-9 interpretations,
  • The lack of clarity concerning the U.S. Immigration and Customs Enforcement (ICE) electronic I-9 regulation, and
  • The issue whether the ICE requirement that original documents be “physically inspected” might be interpreted to allow not only in-person reviews but also virtual inspections.

This Seyfarth Immigration Compliance Group webinar focues on the extended temporary allowance for virtual I-9 completion (until December 31, 2021) granted by ICE.  It also addresses the practical logistics of returning to business, and considers problems employers face in attempting to satisfy federal government directives on the completion and updating of Form I-9s. Our panel considers both legal and practical immigration compliance issues as well as the need to modernize the employment eligibility system.
