"'Scum With a Gun': Facebook Fraud Case Heats Up in New Jersey"

Seyfarth Shaw New York Wage & Hour attorney Aaron Warshaw was quoted in an article on ABCNews.com on November 2. The article described a New Jersey case regarding a woman who created a Facebook profile of her ex-boyfriend and posted untrue statements as if it were him writing them.

"Normally this would be a simple defamation suit. A civil suit," Aaron said.

The article noted that the state of New Jersey has yet to address social networks in laws regarding identity theft.

"If you wanted to create a test, this is probably as good a case as you're ever going to get," he remarked.

"The legitimate interest of the government is that people shouldn't be going online, faking their voice and hurting other people," Aaron commented. "But in practice, you have to protect against overzealous prosecutors. And that balance needs to be written in to the statute."
