Andy Scroggins Discusses Fired EEOC Member Challenging Anti-Bias Authority in Bloomberg Law

Bloomberg Law quoted Andy Scroggins in its article, “Fired EEOC Member’s Case Tests Trump Power Over Anti-Bias Agency,” on April 15. Scroggins discussed how Jocelyn Samuels, former EEOC vice chair, must prove her case without the legal protections other agency heads have against dismissal without cause.

“She’s saying the statute doesn’t have explicit provisions that would allow for her removal, and invites the court to read into the statute protections from being removed by the fact that Congress designed the appointments to be for a fixed term.”
