Ariel Cudkowicz was quoted in the April 15, 2010 American Lawyer article, "What's Next." The article discussed predictions from top labor and employment lawyers about what they expect in the years ahead. According to the article, labor and employment attorneys have not had a lot of downtime in the past few years as the recent economic downturn has resulted in an increased demand for advice on plant closings, layoffs, and pay and benefit cuts. The article also noted that even with the recession ending, these same lawyers are even busier with the Obama administration stepping up its workplace enforcement efforts.

According to the article, private litigation on behalf of independent contractors who claim they've been misclassified and are entitled to back pay, overtime, and benefits is one of the issues on the rise. Ariel noted that "We've been seeing it spread across industries." He added that the recent wave of class actions began with FedEx drivers and has expanded to include everyone from cable television installers and construction workers to messengers, truck drivers, and even exotic dancers.
