The May/June 2006 issue of HR Advisor carries an article by Bob and Beth entitled "Terminating and Executive: Key Steps to Minimize Liability" that outlines key issues for HR professionals to consider in the termination process of an executive. They note that "All terminations are serious and can lead to litigation, but the termination of a senior executive often has more significant ramifications. . . . executives generally have more significant ties to the organization than lower-level employees, sand their termination will be felt more deeply both within the organization and often outside the organization as well." Among the issues HR professionals need to consider are: employment discrimination based on age or gender; an employment agreement that specifies obligations including severance, bonus, deferred compensation; confidentiality concerns; tax issues; indemnification and resolution of any disputes.
