“2nd Circ. To Weigh FLSA Class Waivers In Citigroup Case”

Seyfarth Shaw Labor & Employment partner Brandon McKelvey is quoted in a March 19 Law360 article discussing the recent appeal of a ruling that blocked Citigroup Inc. from enforcing an arbitration agreement that forced employees to waive collective action rights.

According to Brandon, “The whole issue is in this, ‘Can an employmentarbitration agreement preclude an FLSA class action?'" He added, "I think what this [case] does is it adds another piece to the arbitration-collective action puzzle…This is just one step along the way of figuring out this issue."
