Brett Bartlett Discusses AI Testing Overtime Exemptions Under FLSA in Bloomberg Law

Bloomberg Law quoted Brett Bartlett in its article, “AI Boosts Chances White-Collar Jobs Are Eligible for Overtime,” on August 5. Bartlett discussed how the increasing use of artificial intelligence could lead to white-collar employees becoming eligible for overtime pay.

“Unlike the California law, the FLSA has a qualitative primary duty test that looks at the employee’s key value to the employer and doesn’t give the percentage of time spent on exempt work versus non-exempt work.”
