"Wage Suits Get a New Poster Boy"

Seyfarth Shaw Labor & Employment partner Brian Ashe was quoted by The Recorder in an article recounting a contentious series of wage and hour lawsuits filed against a San Francisco restaurant.

The plaintiffs claim the restaurant improperly pooled tips, however the restaurant owners claim the plaintiffs' cases threaten the viability of their northern California locations because the suits are unusually aggressive and penal, pointing to a number of unusual tactics, including a demurrer filed in response to one motion that they claim had little purpose except to run up fees.

Brian agreed with the defendants that demurrers are highly uncommon--he's encountered only one in his entire career. He also noted, however, they are rarely successful.
