Attorneys in Seyfarth’s Business Immigration Group discuss how employers can seek and obtain visa and entry ban exemptions and exceptions under the latest U.S. Department of State and Department of Homeland Security guidance and interpretations. While the discussion focuses on strategies to help key H-1B and L-1 workers, the panelists also offer strategies that assist other nonimmigrant business and employment-based applicants.

Discussion topics include:

  • Which noncitizens are covered by the bans, and which are not?
  • Strategies to secure an emergency visa interview appointment despite consular shutdowns.
  • Understanding the respective roles and powers of consular officers, the State Department, border inspectors, U.S. Customs and Border Protection, and air carriers.
  • Distinguishing key differences between the labor-market work visa bans and the COVID-19 proclamations barring entry from restricted regions (the United Kingdom, the European Schengen Area, Ireland, China, Brazil, and Iran).
  • Developing persuasive evidence to qualify for national interest exemptions under the State Department’s July 22nd and August 12th postings.
  • Strategies to show that travel is necessary to aid in COVID-19 healthcare efforts or to “facilitate the immediate and continued U.S. economic recovery.”
