Articles Highlight Camille's Testimony on ENDA Legislation before House Committee
Camille Olson was quoted in the September 23, 2009 Law360 article, "EEOC Voices Strong Support For ENDA Legislation," and the September 24, 2009 Workforce Management article, "Sexual Orientation Bias Bill Starts Moving Again." The articles discussed a hearing before the U.S. House of Representatives Committee on Education and Labor to consider H.R. 3017, the Employment Non-Discrimination Act of 2009 (ENDA). Camille served as a committee witness at the hearing where she testified about certain practical uncertainties that employers are likely to face when attempting to comply with ENDA’s provisions and sections of the legislation that may cause confusion for employees attempting to understand their rights and obligations under ENDA.
According to the Law360 article, Camille called for closer inspection and clarification of ENDA's language, particularly as it applies to disparate-impact claims and its requirement of adequate facilities for transgendered and transsexual employees. She also expressed concerns about ENDA's provisions for attorneys' fees in cases brought under the law. She noted the bill would allow the award of attorneys' fees in administrative proceedings, which goes against the “investigative and reconciliatory” purposes of EEOC and employment administrators' actions.
The Workforce Management article also noted that Camille testified that the bill is ambiguous about standards that companies with transgender workers must meet for “shared facilities,” which could include dressing rooms and restrooms. The article added that Camille said it is unclear whether companies would have to modify offices and production centers.
