Changes in Admission Period for B Visa Visitors
Persons entering the U.S. in B-2 tourist visitor status had previously been granted an automatic six-month stay, with the possibility to extend that stay for an additional six-month period. INS now proposes to admit B-2 tourist visitors (as well as B-1 business visitors) for a period of time that is “fair and reasonable” in order to complete the purpose of the visit. Where the time required to complete the purpose of the visit is not clear or is not expressed, INS will grant a 30-day period of admission. Similarly, extensions of stay in B visa status will be limited to a maximum period of six months (decreased from one year), and then only upon a showing of unexpected circumstance or for compelling humanitarian reason. Under the INS proposal, there would be some exceptions to the extension limitation.
