The November 9 edition of The Houston Chronicle quoted Houston partner Chip Galagaza in an article regarding the Supreme Court’s recent ruling that companies must pay workers for the time it takes to change into protective clothing and safety gear and to walk to their work stations – a period known as “don and doff” time. The Supreme Court ruling renders null a 2002 decision by the 5th U.S. Circuit Court of Appeals, the article relates, which ruled that employers did not have to pay for don and doff time.

The article states “Chip Galagaza, a lawyer with Seyfarth Shaw who represents employers, said he wasn’t surprised by the Supreme Court’s unanimous verdict that stemmed from a similar case in Maine, where a court there relied on the 5th Circuit’s decision. ‘Paying to don and doff is a principle that’s been around since the mid-1950s,’ he said.”
