Chris DeGroff Discusses Fitness-for-Duty Tests in SHRM
SHRM quoted Chris DeGroff in its article, “U.S. Marshals Pay $15 Million to Settle Race Discrimination Case,” on December 13. DeGroff discussed fitness-for-duty tests in Fogg v. Garland, a long-standing class-action lawsuit alleging racial discrimination in hiring, promotions, and job assignments.
“Employers must be able to describe how and why they use fitness-for-duty tests and must also be prepared to explain why individuals in protected classes were treated differently.”
