“Denial of Services to Children Based on HIV Status Prompts Discrimination Claims”
Condon McGlothlen was quoted in the February 25, 2010 Disability Compliance Bulletin article, “Denial of Services to Children Based on HIV Status Prompts Discrimination Claims.” The article discussed how misinformation regarding the ways the HIV virus can spread had lead to recent discrimination claims under the ADA and Rehabilitation Act.
According to the article, a district court granted summary judgment to a boy with HIV, finding that a day camp denied him admission because camp officials believed he posed a threat to other campers. Condon suggested that camps or other places of public accommodation in this situation do two things to protect themselves: seek the advice of legal counsel and obtain an informed medical opinion from an infectious disease specialist. The article noted how camp administrators are in a delicate situation when they are notified of a child’s HIV status because they question if they have a duty to notify the other parents. Condon noted, “If the disease specialist says there is no notable medical risk of transmission, I think the camp can be sure that it doesn’t have a duty to notify parents."
