“Do New Job Tests Foster Bias?”

Seyfarth Shaw Labor & Employment partner Condon McGlothlen was quoted in The Wall Street Journal on September 20. The article discusses the uptick in companies using online pre-employment tests which have started to result in complaints of bias. Condon remarks of the tests, “You don’t get the results back in the employment context, so you don’t know whether it was the test or what part of the test that made you fail. There are so many more unknowns, particularly in the application stage.”
