Dana Peterson Quoted in The Recorder
“Medical Leave Cases on Upswing, Employment Lawyers Say”
Employment partner Dana Peterson was quoted in a recent issue of The Recorder. The article discussed various opinions regarding the increase in disability discrimination and failure to accommodate claims in California. Dana commented that she used to see more disability claims based upon physical disabilities, for example, cancer or back conditions, but now is seeing an increase in psychological claims, like depression and anxiety disorders. Dana noted that people are stressed about their jobs and workload and stress-related conditions can be disabilities. Dana attributes the increase, especially in stress claims, to the 2002 broadening of California's disability laws and noted that “this is not going away anytime soon."
