David Baffa was quoted in the July 29, 2010 Employment Law360 article, “Sherrod Debacle Highlights Perils Of Hasty Firing.” The article discussed what employers can learn from the recent controversial forced resignation of  U.S. Department of Agriculture staffer, Shirley Sherrod.

In light of the Sherrod incident, commentators noted that in addition to conducting due diligence, employers may also want to have a policy in place that addresses their expectation for an employee’s behavior outside the workplace. Dave pointed out, “You can imagine plenty of situations where something an employee chooses to do on his or her own time nevertheless ends up poisoning the work environment, which is the point where it legally becomes the employer’s business.”
