On October 3, 2008, President Bush signed into law the Emergency Economic Stabilization Act of 2008 (the “Act”). The Act provides the Secretary of the Treasury (the “Secretary”) with unprecedented “authority and facilities” designed to restore liquidity and stability to the financial system of the United States.
