"Employers advised to review strict policies on leave time"
Seyfarth Shaw Labor & Employment partner Ellen McLaughlin was quoted in Business Insurance on August 21. The article advised employers to reconsider their leave policies, since the Equal Employment Opportunity Commission (EEOC) has been quick to pursue litigation against companies whose workers choose to take their leave under the Americans with Disabilities Act (ADA).
According to Ellen, the EEOC wants companies to notify their employees when they've nearly reached their maximum allotted leave, and grant those employees the option of asking for an accommodation so they may either return to work or extend their leave.
Ellen noted that it is important that human resources personnel are "trained to understand that when an employee asks for additional leave time, or suggests something that may assist them in returning to work, that they need to begin the interactive process with that employee."
