“Are New FMLA Regulations on the Horizon?”

Ellen McLaughlin was quoted in in the article, “Are New FMLA Regulations on the Horizon?” published November 28, 2007 in CCH’s Business & Corporate Compliance newsletter.

The article notes that the US Department of Labor had planned to review the FMLA regulations in 2007, but that it seems that no revisions of the regulations are currently on the horizon. The article referred to a presentation given by Ellen at the 28th Annual Conference in Employment Law at which she “remarked that the DOL’s December 2006 request for public comments, rather than issue proposed new rules puzzled many. It was even more surprising that in June 2007, the DOL released a lengthy analysis iof the more than 15,000 comments it received, highlighting particular areas of conflict.” The article also noted that Ellen “reported that one DOL official speaking at an American Bar Association event indicated that the Department has begun examining whether changes are needed to the model medical certification form.”
