Chicago employment attorney Pamela Devata was quoted in the December 2010 edition of HR Magazine discussing the increased use of background screening by employers. According to the article, large employers are far more likely to conduct checks, but many mid-sized and smaller ones also conduct some kind of background check for at least some positions. Pam, citing the Texas case Bohne v. Enviroclean Management Services Inc. as an example, explained that in state courts "there are more negligent hiring and retention claims. But these are tricky waters to navigate." In fact, federal officials are looking closely at hiring practices and policies related to criminal and credit histories.
